行走在大山里的“流動法庭”

地處大山深處的淄博市沂源縣人民法院東里法庭，距沂源縣城43公里，是淄博市最偏遠的一處法庭。東里法庭共有5名正式干警，多年來，他們堅持走進田間地頭開展普法宣傳，積極推行巡回審判，把法庭搬到村中、果園，搬到農戶家中，極大延伸了司法服務的觸角，被當地群眾親切地稱為行走在大山里的“流動法庭”。

東里法庭管轄東里、張家坡、中莊、西里4個鎮的民商事糾紛，而這4個鎮都是林果大鎮，林果收入是群眾的主要經濟來源，因果品交易引發的各類糾紛多發易發。為全力維護果農的經濟利益，推進果業經濟的發展，東里法庭創造性地在未設法庭的鎮設立了3處“鄉土調解室”，聘請當地熟悉果品生意、熱情擔當、有威信的6名鄉賢為特邀調解員調處民事糾紛。近年來，共疏導、化解涉果品糾紛368件，涉及果農近千人。

在此基礎上，為預防和化解矛盾糾紛，法庭干警圍繞果品的生產、銷售、存儲等時間節點，走進村戶、深入果園田間，把開展風險提示、提供法律知識、發放合同樣板等特色司法服務送到果農身邊，提高果農知法、守法、用法意識，有效減少果業鏈所引發的各類糾紛。

多年來，東里法庭干警堅持把非訴訟糾紛解決機制挺在前面，踐行“能調不訴、能調不判”的司法理念，把調解作為解決糾紛的首選方式，建立起了集在線調解、調解指導、巡回審判、法治宣傳等功能于一體的“e+巡回智慧法庭”，一網多點，調解員就地調解，法官線上指導，讓群眾就近享受高效、便捷的司法服務。對于他們來說，樹上、凳子上、炕頭……只要是可以放正國徽的地方，就可以開庭。

幾年來，東里法庭干警的年行程近12萬公里，法官年人均結案近300件，案件服判息訴率達到96%以上，調撤率達到70%以上，無一信訪投訴。堅持多年開展送法上門的王超感慨地說：“進村入戶、行走山間，雖然增加了我們的工作量，但我們和群眾的距離卻越來越近，愿我們的司法服務讓山區群眾的糾紛少一點，幸福多一些。”

“Mobile Tribunal” in Mountains

The Dongli Tribunal of the Yiyuan County Peoples Court， Zibo， located in the depths of mountains， 43 kilometers away from Yiyuan County， is the most remote tribunal in Zibo. In the tribunal， there are a total of five court police officers. Over the years， they have insisted on carrying out law popularization in rural areas， actively conducted circuit trials， and moved courtrooms to villages， orchards and peasantshomes， thereby greatly extending the tentacles of judicial service. The local masses affectionately call it the “Mobile Tribunal” in mountains.

The Dongli Tribunal has jurisdiction over the civil and commercial disputes of four towns， Dongli， Zhangjiapo， Zhongzhuang， and Xili， which are all major towns abounding in fruit. The income from fruit is the masses major economic source， thus various disputes arising from fruit trading often occur. For years， the court police officers of the tribunal has been persisting in giving top priority to the alternative dispute resolution mechanism， practicing the judicial idea of “putting mediation before litigation and judgment”， and taking mediation as the preferred mode of settling disputes. Besides， they have built an “e+ Smart Circuit Tribunal”， which integrates such functions as online mediation， mediation guidance， circuit trials， and legal publicity， with one network and multiple spots， and allows mediators to conduct one-the-spot mediation， judges to provide online guidance， and the masses to enjoy efficient and convenient judicial service nearby.

Melt winter snow and solid ice with sincerity. In the several years， these court police officers traveled nearly 120，000 kilometers a year； judges closed nearly 300 cases per capita every year； the judgment acceptance rate and the lawsuit withdrawal rate reached above 96% and 70% respectively， with no complaints.
