Abstract：Theessayisbasedonthejournalarticle，LegislatingforTouristAttractionsRightsbyprofessorBao JigangandprofessorZuoBing，whoadvocatetointroducelegislationfortourismattractionsortoamendtheProperty Lawassolutionstotheconflictsbetweendevelopersandruralcommunitiesonhowtoequitablydistributetourism revenuesgeneratedbytouristattractions.Itisundeniablethattouristattractionswhichcannotbedividedfromrural landandtourismrevenueshavecausedseriousconflictsbetweendevelopersandruralcommunities，butitisnot feasibletolegislateforaTouristAttractionPropertyRight（TAPR）whichismadeupofthousandsofvarious mattersasanindependentindividualinlaw.Regardedasanaggregateconceptintouristresearch，atourist attractionisaprofessionaltermfromtourismsciencethathasnotbeenruledbylaw.Butdifferentpropertiesof tourismattractions，suchasindividuals，areprotectedbyPropertyLaw，amongwhichsometouristattractionsare beinglistedintheexistingcategoriesofrightsinthePropertyLawinChina.Solegislatingfortourismattractionto someextent，willdefinitelywastejudicialresources.Thisessayanalysespropertyrightsofsometypicaltourist attractionssuchastouristfacilities，transportationfacilities，touristresourcesandsoonaswellasclarifyingsome relatedissuesoftourismattractionpropertyrightsputforwardbyprofessorBao.Italsoshowsindetailwhy legislatingfortourismattractionsasanaggregationisirrationalandinfeasibleinlawbytheoryofPropertyLawas wellasTourismLaw.Thebestwaytosolvetheconflictscausedbytouristattractionsanditsbenefitsistoguarantee afair，equitableandexecutablecontractbetweendevelopersandcommunities.Itisurgenttohelpcommunities improvetheirlegalknowledgeforprotectingtheirrightsinsteadofinsteadofresortingtoviolenceordestroyingthe environment.Inaddition，theessaysuggestsmakingfulluseofContractLaw，TourismLawrelatedexistinglaws andjudicialexplanationstosolvetheproblemsofcommunityrightsprotectioninruraltourismdevelopmentandthe conflictsoftourismincomedistributionamongcommunities，developersandgovernments，insteadofsimply amendinglaws.
