美國(guó)地方公共圖書(shū)館危機(jī)管理研究

摘 要 論文分析了美國(guó)各州公共圖書(shū)館法中的危機(jī)管理?xiàng)l款，包括圖書(shū)館資料盜竊、消防安全、網(wǎng)絡(luò)安全、資金安全、設(shè)施安全等。并在比較分析我國(guó)部分省、市公共圖書(shū)館管理?xiàng)l例中相關(guān)問(wèn)題的基礎(chǔ)上，探討了美國(guó)各州公共圖書(shū)館立法實(shí)踐對(duì)我國(guó)公共圖書(shū)館立法的啟示。

On the Crisis Management of Local Public Libraries of USA：Analysis Based on the State Library Law

Abstract This paper analyses the crisis management items in the public library laws of American states，including theft of library materials，fire safety，Internet safety，financial security，facilities security and so on. And it discusses the enlightenments of the public library laws of American states for Chinese，based on the comparative analysis of the crisis management in some Chinese provincial and municipal public library rules.

1 美國(guó)各州公共圖書(shū)館法危機(jī)管理概況

美國(guó)每一個(gè)州的法典上都載有公共圖書(shū)館法，各州圖書(shū)館法則是州圖書(shū)館專門法及其他法律中與圖書(shū)館相關(guān)條例的綜合，大都涉及各種不同類型的圖書(shū)館，內(nèi)容詳簡(jiǎn)不一[1]。

美國(guó)共有50個(gè)州和1個(gè)哥倫比亞特區(qū)，其中12個(gè)州的公共圖書(shū)館法涉及到危機(jī)管理或安全管理，占州總數(shù)的23.5%，見(jiàn)表1。

從表1可知，涉及危機(jī)管理的州公共圖書(shū)館法頒布時(shí)間較為集中。其中最早的是2002年修訂的《馬里蘭州公共圖書(shū)館法》，主要涉及了圖書(shū)館資料盜竊、建筑設(shè)施安全和消防安全[2]。最新頒布的是2010年修訂的《加利福尼亞州圖書(shū)館法》，主要涉及了圖書(shū)館資料盜竊、火災(zāi)系統(tǒng)、資金安全和圖書(shū)館設(shè)施安全[3]，以及2010年修訂的《密西西比州圖書(shū)館資料安全法》[4]。其中涉及互聯(lián)網(wǎng)安全的只有科羅拉多州2009年修訂的《科羅拉多州圖書(shū)館法》和猶他州2008年修訂的《猶他州的圖書(shū)館法》[5-6]。危機(jī)管理在公共圖書(shū)館法中被頻繁提及，反映出圖書(shū)館危機(jī)管理得到了圖書(shū)館法律制定者的關(guān)注與認(rèn)同，圖書(shū)館危機(jī)管理在法律保障下應(yīng)該會(huì)更加科學(xué)與規(guī)范，說(shuō)明圖書(shū)館危機(jī)管理研究與實(shí)踐已經(jīng)進(jìn)入新的階段，圖書(shū)館應(yīng)該加強(qiáng)危機(jī)管理制度建設(shè)，進(jìn)一步推動(dòng)危機(jī)管理法制化進(jìn)程。……
