專利價值評估工具的有效性比較研究

〔摘 要〕[目的/意義]專利價值評估工具已經應用非常廣泛，但其評估結論是否有效尚有爭議。[方法/過程]本文以某高校最近三年已實際發生專利權轉移交易的專利為研究樣本，以實際交易價格與現已公開應用的3個專利價值評估模型的評估值進行比較，利用相關分析和回歸分析等數理統計方法驗證Innography、IncoPat和PatSnap作為專利價值評估工具的有效性。[結果/結論]本研究涉及的交易樣本數據表明：PatSnap在評估專利價值上具有較高的可靠性，評估結果可作為交易的參考價格供買賣雙方參考；IncoPat評估的專利價值度與真實交易價格的自然對數值有較高的相關性，而Innography評估的專利強度與真實價格的相關性一般。PatSnap的價值評估結果可作為交易的參考價格供買賣雙方參考，也可用來評估專利作為高校無形資產的價值。

〔Abstract〕[Purpose/Significance]The patent value evaluation tools have been widely used，but it is still controversial whether the evaluation conclusion is valid or not.[Methods/Process]This paper compared the evaluation value with the actual transaction price of the patent which has actually sold by a university in the last three years.The SPSS statistics was used to calculate relevance of the valuation and the actual transaction price，verify the effectiveness of Innography，IncoPat and PatSnap as patent valuation tools.[Result /Conclusion]Research showed that PatSnap had high reliability in the evaluation of patent value，the evaluation results could be used as a trading reference price for both reference.The patent strength of IncoPat evaluation had a high correlation with the natural logarithm value of the real transaction price，while the correlation between the patent strength of Innography evaluation and the real price was in general.The value assessment results of PatSnap could be used as reference prices for both buyers and sellers，and could also be used to assess the value of patents as intangible assets of colleges and universities.

眾所周知，在專利交易過程中定價是核心環節，如何對專利價值實現精確的評價或評估，歷來是學術界和企業界關注的焦點，至今并無公認的方法[1-3]。同時在專利估值中單個專利的價值又是最難估計的[4]。

目前專利交易中的估值方法有很多種，但最基本的方法有兩種，分別是市場估值法和模型估算法。市場估值法一般用于專利交易較為活躍的情況，如果相關領域的專利交易數據足夠多，則過去的交易價格可為類似的專利交易作為參考。但是，當交易不活躍的時候，市場估值法的應用就受到了限制?！?br>
