[摘要] 對于公立醫院來講,創建醫院的和諧勞動關系構成了現階段的醫院管理要點。編制外人員屬于特殊的勞動者群體,并且編制外人員在公立醫院的范圍內占據關鍵地位。為了切實保障編制外人員的合法權益,那么目前必須著眼于此類人員的勞動合同管理,確保勞動合同能真正成為保護公立醫院編制外人員的重要憑據。在此前提下,公立醫院管理者需要明確勞動合同管理對于保護編制外人員基本勞動權益的重要意義,并且結合公立醫院管理編制外人員的現狀來完善現有的勞動合同管理模式。

[Abstract] For public hospitals, creating harmonious labor relations in hospitals constitutes the main points of hospital management at this stage. Non-staff personnel belong to a special group of workers, and non-staff personnel occupy a key position within the scope of public hospitals. In order to effectively protect the legitimate rights and interests of non-staff personnel, it is necessary to focus on the labor contract management of such personnel to ensure that the labor contract can truly become an important credential for protecting non-staff personnel in public hospitals. Under this premise, the managers of public hospitals need to clarify the significance of labor contract management to protect the basic labor rights and interests of non-staff personnel, and to improve the existing labor contract management model in accordance with the status of non-staff personnel in public hospitals.

近些年以來,很多公立醫院受到有限的核定編制影響,因此傾向于引進編制外的聘用人員。在公立醫院現有的全體職工范圍內,編制外人員逐漸占據了顯著的醫院勞動者比例[1]。與編制內的用工方式進行對比,醫院對于編制外人員進行聘任的做法可以減少現階段的用工政策局限,進而體現了靈活機動的用人機制優勢。但是與此同時,聘任編制外的特殊勞動者很可能引發多種多樣的醫院內部勞資糾紛,甚至顯著影響了良好的醫院內部勞動關系[2]。由此可見,現代公立醫院必須認識到編制外人員納入醫院勞動合同管理的必要性,并且保證勞資雙方對于勞動合同都能夠切實予以遵守。
