摘要:隨著“互聯網+”模式在各個領域的飛速發(fā)展,網絡餐飲“O2O”模式已經成為餐飲行業(yè)的重要發(fā)展方向。從網絡餐飲市場的興起到現在的十年里,網絡餐飲市場可謂是蓬勃發(fā)展,經歷了2015年爆發(fā)式增長,到2019年仍保持其高速發(fā)展。2017年中國網上訂餐市場規(guī)模達到2052.7億元,占總餐飲市場規(guī)模的三分之一。發(fā)展的同時各種問題也愈演愈烈,食品安全問題、監(jiān)管問題、消費者權益等問題都亟待解決。本文通過闡述網絡餐飲發(fā)展狀況與監(jiān)管方面相關問題,提出相關建議和對策,從而更好地服務于廣大消費群體,讓所有人吃上放心安全的食物。

Abstract: With the rapid development of the "Internet +" mode in various fields, the online catering "O2O" mode has become a major development direction of the catering industry. From the rise of the online catering market to recently, the online catering market has flourished in the past decade. It has experienced explosive growth in 2015 and still maintaining its rapid development in 2019. In 2017, the online ordering market in China reached 205.27 billion CNY, accounting for one-third of the total catering market. At the same time, various problems have intensified. Food safety issues, regulatory issues, consumer rights and other issues have to be resolved. This paper puts forward relevant suggestions and measures by expounding the problems related to the development status and supervision of online catering, so that consumers can enjoy better service and safe food.

1.前言
近幾年來,中國網絡餐飲020市場不斷擴大 ,極大地推動了傳統(tǒng)餐飲行業(yè)的轉型發(fā)展,但相關標準和規(guī)定缺失、執(zhí)行力度低、進入門檻低等導致“互聯網+”餐飲行業(yè)魚龍混雜,在這片傳統(tǒng)監(jiān)管的盲區(qū)里,產生了諸多新的食品安全問題。針對食品安全問題,各個國家都因地制宜地建立了一套符合自己國情的食品安全監(jiān)管法律體系[1]。美國的食品安全法律體系是以《聯邦食品、藥品與化妝品法》為主導,以檢驗法、食品質量保障法、食品安全現代化法、公共衛(wèi)生服務法等法律為基礎而建立的[2],[3]其中食品安全現代化法進一步提升了美國的食品安全治理體系;歐盟的食品安全法律體系是以“從農田到餐桌”理念來建立的 [4]。在經濟全球化背景下,食品安全問題頻出,未知風險、人為風險、衍生風險較大[5]。……
