基于利益博弈視角的土地信托流轉研究

摘 要：土地信托流轉是參與主體在現有制度下為追求自身利益最大化而進行博弈的結果。湖南省益陽市草尾鎮創新土地流轉形式，采用“政府出資+市場運作+農戶自愿”的運作模式，形成了在全國十分具有典型性和代表性的土地信托流轉模式——“草尾模式”。該模式對于抑制土地拋荒、實現土地規模經營等都有非常明顯的效果。分析了參與土地信托流轉的利益主體的利益訴求，并基于博弈理論分析了在有無土地信托公司的情況下流出方與流入方的利益博弈，最后提出了完善土地信托流轉機制的相關建議。

Abstract：Based on the operation mode of “government investment， market operation and farmers voluntary”， Caowei town， which was in Yiyang City of Hunan Province made innovation forms of land circulation， formed a typical and representative land trust transfer mode in the city—“Caowei town Model”. This model had obvious advantages for the suppression of abandoned land and realized the scale management of land. Land trust transfer was the result of the game in which the participants were pursuing maximizing their own interests under the existing system. This paper analyzed the interests of the stakeholders involved in the land trust transfer. Then based on the game theory， the paper analyzed the interest game between the inflow side and the outflow side under two situations， one was with the land trust company and the other was without the land trust company. Finally， this paper put forward some relevant suggestions to improve the land trust transfer mechanism.

為積極響應黨中央號召，大力推進“農業現代化”，一種新的土地承包經營權流轉制度——土地信托流轉制度嶄露頭角，為解決“三農”問題提供了全新的思路。目前，浙江紹興、安徽宿州、河南安陽和湖南益陽等地已經出現土地信托流轉的萌芽，并在實踐過程中積累了一定經驗。在中國特定土地體制下，土地信托流轉制度的制定和執行要取得預期的效果，各利益相關主體的參與程度十分關鍵[1]。筆者結合益陽“草尾模式”，從利益博弈的全新視角，分析“草尾模式”利益主體的訴求，進一步研究在有、無土地信托公司情況下流出方與流入方之間的博弈，并在此基礎上提出完善現存土地信托流轉機制的建議。
