我國PPP項目實施流程的風險分析

摘要：PPP模式，是基于BOT及PFI模式發展的基礎上，廣泛運用于公共事業服務、基礎設施完善的又一綜合性的項目發展模式。自黨的十九大召開，PPP模式成為重點關注的對象，也成為國家出臺法律條文來指導的最為集中的行業領域，其自身維度的擴寬，政府的積極實踐與相關體制的規范，對于PPP項目的規范性運營起著至關重要的作用。因此，本文基于PPP項目的參與方結構流程、項目整體發展推進中可能面臨的風險，針對具體的問題進行針對性的情況說明，并提出具體的應對策略，力圖為我國PPP項目的規范運作和發展提出建設性的參考建議。

Abstract： Based on the development of BOT and PFI modes， PPP mode is a comprehensive project development mode which widely used in public service and infrastructure improvement. Since the 19th National Congress of the Communist Party of China （CPC）， PPP mode has become the focus of attention and the most concentrated industry field under the guidance of national laws and regulations. The expansion of its own dimensions， the active practice of the government and the regulation of relevant systems play a crucial role in the standardized operation of PPP projects. Therefore， based on the participant structure and process of PPP project and the possible risks in the overall development and promotion of the project， this paper explains the specific problems and puts forward specific coping strategies， trying to put forward constructive reference suggestions for the standardized operation and development of PPP projects in China.

0 ?引言

PPP項目[1]（Public-Private-Partnership）是指政府與私人在項目上達成合作關系的一種模式，其具體定義在國際與國內間還未形成一種統一的理論共識。從我國重大項目的運營方式看：具體是指政府與社會各個組織、機構、民營團體在重大項目上謀求合作的一種方式。它既滲透到資金的投入、組織管理的實施、又貫穿至后期的項目運營及項目移交等方面?？梢哉f：它涵蓋的內容“廣而大，深而遠”，既包括傳統意義上的BOT（建設-經營-轉讓）發展模式，也包括其他的企業合作方式中的公私合營與PFI（民間主動融資）的運作方式。

自改革開放以來，我國通過BOT、PFI模式的成功運用，在公共基礎服務及基礎設施建設上取得了令世人矚目的成就。當前，在世界經濟一體化的大背景下，我國重視PPP項目的運用和政策上的引導，這對于我國重點項目的開展運營、消除城鄉貧困、完善基層項目建設、提升居民生活幸福指數具有重大的積極意義[2]?！?br>
