法經濟學課程設置探析

摘要 作為一門新興交叉學科,法經濟學將經濟學的基本理論與分析方法引入法學的研究中,對于開拓研究視野、促進學科的相互融合和發(fā)展、提高人才培養(yǎng)質量有重要意義。國內高等院校法經濟學課程設置不足以支撐法經濟學學科的長足發(fā)展,著眼于學科意義上的法經濟學建設,應從方法論意義上的法經濟學著手,可以借鑒國外法經濟學課程設置的經驗,通過教材建設和師資建設,完善法經濟學課程設置,解決國內法經濟學學術研究的“兩張皮”現象,為高水平法經濟學研究人員的培養(yǎng)奠定基礎。

Analysis of Establishment of Law & Economics Curriculum//Wan Guangjun

Abstract Law & Economics is an emerging interdisciplinary subject, the using of the elementary theory and the analysis method of economic to the legal research have the important meaning to the development of research field of vision, the promotion of disciplines mutual fusion and the enhancement of the personnel quality. The present situation of curriculum establishment of Law & Economics subject in domestic institutions is insufficient to support the considerable development of Law & Economics subject. We should focus the construction in the discipline significance and begin from the methodology significance. Through study of the overseas experience of the establishment of Law & Economics curriculum and the construction of teaching material and the teachers, we can perfect the curriculum establishment of Law & Economics, solute the “two skins” phenomenon in national Law & Economics research and lay the foundation for the raise of high level Law & Economics researcher.

法經濟學是用經濟學的理論與分析方法,而且主要是運用價格理論(或稱微觀經濟學),以及運用福利經濟學、公共選擇理論及其他有關實證和規(guī)范方法考察、研究特定社會的法律和法律制度的形成、結構、過程、效果、效率及未來發(fā)展的學科[1]。國內法經濟學研究已逐步脫離僅僅介紹國外成果的階段,開始在各個法律領域中發(fā)掘法律經濟學切入的可能性,并且取得不小的成就[2]。20世紀80年代以來,法經濟學呈現出新的發(fā)展趨勢,它逐漸由北美、歐洲被介紹到世界各地,法經濟學的論著接連問世,學術刊物日益增多,學術會議頻繁召開,一場國際性的“法經濟學運動”在世界不同類型的國家或區(qū)域展開。因此,任何回避或藐視這場運動的行為都是不明智的。……
