【摘要】近年來為了實(shí)現(xiàn)培養(yǎng)既懂法律又能熟練運(yùn)用英語(yǔ)的高素質(zhì)復(fù)合型人才的教學(xué)目標(biāo),全國(guó)各大高校法學(xué)專業(yè)紛紛開設(shè)了法學(xué)英漢雙語(yǔ)課程,但在法學(xué)雙語(yǔ)教學(xué)實(shí)踐中,不少高校卻出現(xiàn)了與法律英語(yǔ)教學(xué)相混淆的情況。本文旨在區(qū)分法律英語(yǔ)教學(xué)和法學(xué)專業(yè)雙語(yǔ)教學(xué)性質(zhì)的基礎(chǔ)上對(duì)法學(xué)雙語(yǔ)課堂中有關(guān)英漢兩種語(yǔ)言運(yùn)用比例、法學(xué)雙語(yǔ)教學(xué)師資、教學(xué)方法及教學(xué)內(nèi)容等方面問題展開一些探討,以期進(jìn)一步改進(jìn)和完善法學(xué)雙語(yǔ)課程教學(xué)。

【Abstract】In recent years the colleges and universities all over the country set up the bilingual courses in major of law in order to realize the teaching goal of cultivating the talents with high qualities in both law and English, but in the practice of bilingual teaching of law, many colleges and universities appeared the situation of confusing with legal English teaching. The purpose of this paper is on the basis of distinguishing the nature of legal English teaching and bilingual teaching of law to discuss some questions such as the proportion of using English and Chinese languages, the teaching faculty of bilingual courses, teaching method and teaching contents, etc. so as to further improve and perfect the bilingual teaching of law.

21世紀(jì)是人類進(jìn)入全球一體化的時(shí)代,各國(guó)國(guó)際化交流與合作日益頻繁,隨著中國(guó)加入WTO以后,社會(huì)各個(gè)領(lǐng)域?qū)?fù)合型、外向型、應(yīng)用型國(guó)際化專業(yè)人才的需求也在不斷增大,尤其在以“依法治國(guó)”為目標(biāo)的當(dāng)下中國(guó),既懂外語(yǔ)又具備豐富的法學(xué)專業(yè)知識(shí)的復(fù)合型高素質(zhì)人才顯得尤為稀缺。中國(guó)的法學(xué)教育也應(yīng)該順應(yīng)這一時(shí)代背景,培養(yǎng)出既具有深厚扎實(shí)的法律知識(shí)基礎(chǔ),又能夠熟練地處理涉外法律實(shí)務(wù)的高素質(zhì)法律人才。為了培養(yǎng)國(guó)際化復(fù)合型高素質(zhì)人才,教育部于2001年9月下發(fā)了《關(guān)于加強(qiáng)高等學(xué)校本科教學(xué)工作提高教學(xué)質(zhì)量的若干意見》,鼓勵(lì)在全國(guó)各大高校開展以英語(yǔ)為主的雙語(yǔ)教學(xué),然而從近年各大高校法學(xué)專業(yè)雙語(yǔ)教學(xué)實(shí)踐看來,不少承擔(dān)雙語(yǔ)教學(xué)的教師將法學(xué)雙語(yǔ)課程與法律英語(yǔ)課程相混淆,筆者認(rèn)為,法學(xué)雙語(yǔ)教學(xué)和法律英語(yǔ)教學(xué)本質(zhì)上是不同的,為了進(jìn)一步完善和提升法學(xué)雙語(yǔ)課程的教學(xué)質(zhì)量首先有必要對(duì)兩種課程性質(zhì)做區(qū)分。……
